U.S. Immigration Counsel for Delhi and New Delhi

People in Delhi and New Delhi may obtain remote U.S. immigration counsel from Herman Legal Group. Does New Delhi Now Process Immigrant Visas?

Yes. The U.S. Department of State currently lists New Delhi as a processing post for both immigrant and nonimmigrant visas. It also publishes New Delhi immigrant-visa interview instructions. Older guidance saying every Indian immigrant-visa case must be interviewed in Mumbai should not be treated as a blanket rule.

New Delhi and Mumbai both appear as “All” in the current visa-issuing post directory. The appointment letter and case-specific instructions control the interview location. Do not select a post or complete post-specific steps based only on an old article or another applicant’s case.

The New Delhi Immigrant-Visa Sequence

1. Register and visit the Visa Application Center. Before the embassy interview, register online and schedule a VAC appointment. The VAC collects fingerprints and photographs and records passport-return information.
2. Complete the required medical examination. After receiving the interview date, each applicant must use an approved panel physician in India—not a regular personal doctor—and finish the exam before the interview.
3. Prepare the interview file. Bring the required original civil documents, translations, and photocopies identified by the New Delhi checklist. Do not mail originals to the embassy.
4. Attend the interview. A consular officer reviews the application and evidence. Approval is not guaranteed, so avoid irreversible travel or financial commitments before visa issuance.

Those are immigrant-visa steps. A visitor, student, exchange, or temporary-worker applicant using Form DS-160 must follow the current nonimmigrant process for that classification, even though New Delhi appears on both post lists.

Where Legal Review Can Change the Plan

Legal review should connect the petition, visa category, applicant’s history, and evidence that will reach the consular officer. In a family case, that includes consistency among the I-130 record, DS-260, relationship evidence, civil documents, and affidavit of support. In an employment case, the approved petition, job facts, qualifications, and visa application must tell the same accurate story.

Early review is particularly important after a change since filing or when the record includes a prior refusal, overstay, arrest, removal encounter, inconsistent answer, or possible misrepresentation. Depending on the engagement, HLG may identify the U.S. rule, organize evidence, prepare the client for questions, or advise on a government request for more information.

India Documents: Residence and Nationality Are Not Interchangeable

The correct police document depends on who the applicant is and where the applicant lives. Under the State Department’s current India civil-document guidance:

• An Indian national age 16 or older residing in India obtains a Police Clearance Certificate from a Regional Passport Office.
• An Indian passport holder residing outside India obtains a Statement of No Criminal Record from the appropriate Indian diplomatic mission.
• A non-Indian residing in India obtains a Police Clearance Certificate from the FRRO serving the area of residence.
• A non-Indian who no longer resides in India uses the applicable Indian diplomatic mission identified in the country guidance.

The same official page says Aadhaar is evidence of residence, not proof of Indian citizenship. Birth, marriage, divorce, court, and police records must come from an accepted issuing authority. Documents not in English may require certified English translations under the interview instructions.

How Remote Representation Works

Depending on the agreed scope, HLG may assess the case, prepare filings and legal submissions, review interview documents, and conduct interview preparation by video or telephone. New Delhi’s instructions state that attorneys may not accompany applicants into the waiting room or interview, so counsel’s role focuses on preparation and appropriate follow-up.

An inquiry, website use, or initial consultation does not by itself create an attorney-client relationship. Representation begins only if HLG accepts the matter and the parties enter a written engagement agreement, subject to its scope and terms.

Delhi U.S. Immigration Questions

Are all Indian immigrant-visa interviews still handled in Mumbai?

No. The State Department currently lists both New Delhi and Mumbai for immigrant-visa services. Follow the location on the appointment letter and the instructions for that case.

Is the VAC appointment the visa interview?

No. For a New Delhi immigrant-visa case, the VAC visit is a separate step for fingerprints, photographs, registration, and passport-return information. Complete it before the embassy interview as directed.

Can my regular doctor perform the immigrant-visa medical exam?

No. The State Department requires an approved panel physician. Use the current physician list linked from New Delhi’s instructions and schedule promptly after receiving the interview date.

Do the immigrant-visa instructions apply to a visitor, student, or work visa?

No. Immigrant and nonimmigrant applications use different forms and procedures. Follow the current instructions for the visa classification and the post named in the appointment record.

Which Indian police certificate should I obtain?

It depends on nationality, age, present residence, and sometimes prior residence. Use the State Department’s India guidance and the New Delhi checklist rather than assuming one certificate works for everyone.
