Что такое виза возвращающегося резидента?

Многие постоянные и условные резиденты покидают Америку по разным причинам. Наиболее распространённые причины включают в себя работу, встречу с родными, отпуск. Этим постоянным резидентам (ПР) и условным резидентам (УР) нужно быть осторожными касательно того, как долго они находятся за пределами Соединённых Штатов.

Если они находятся там более года или превышают период разрешения на возвращение, то для возвращения им нужно будет получить новую иммиграционную визу. Пандемия COVID-19 усложняет сроки возвращения для многих резидентов из-за карантинов и общих ограничений на возвращение в Америку из определённых стран, в которых, как считается, высокий риск заболеваемости.

Согласно Государственному департаменту США, визовые законы США предусматривают «специальную иммиграционную визу возвращающегося резидента» для ПР, который находился за пределами Америки более года в силу не зависящих от него обстоятельств.

Виза возвращающегося резидента также называется визой SB-1. Она используется, если вы находились за пределами Америки более года, у вас нет разрешения на возвращение или срок вашего разрешения на возвращение истёк. Обычно разрешения на возвращение позволяют владельцам грин-карт (имеющим статус ПР) находиться за пределами Америки до двух лет.

Если вы находились за пределами США менее года, то ваша карта постоянного резидента позволит вам вернуться в США. По данным Stilt.com, ПР и УР, которые уезжают США, должны получить разрешение на возвращение через форму I-131.

Чтобы получить визу SB-1, вам нужно подать заявление на SB-1 из страны, в которой вы находитесь, обычно через посольство США в этой стране.
